A BILL for
AN ACT to create W.S. 22-2-117 relating to elections; authorizing voters to vote for "None of the above" in lieu of voting for other candidates for public office; requiring an additional election if voters select "None of the above" and declaring losing candidates ineligible for the new election; and providing for an effective date.
Be It Enacted by the Legislature Of the State of Wyoming:
Section 1. W.S. 2-22-117 is created to read:
22-2-117. Voting against all candidates.
(a) Notwithstanding any other provision of law, in each election for any office, other than retention of justices or judges, there shall be included on the ballot with the candidates listed a separate line following all other candidates as follows:
"None of the above."
(b) Any voter may vote for "None of the above" as for any other candidate. If there is only one (1) seat for an office being filled by the election and "None of the above" receives the most votes, a new election shall be held not less than twenty (20) nor more than thirty (30) days after the first election results are certified, but none of the persons who were candidates in the first election are eligible to be candidates in the new election. If there is more than one (1) seat for an office being filled by the election and "None of the above" receives enough votes such that a person receiving the same number of votes would have been elected, a new election shall be held to fill that one (1) seat. The new election shall be held not less than twenty (20) nor more than thirty (30) days after the first election results are certified, but none of the unsuccessful candidates in the first election are eligible to be candidates in the new election.
Section 2.
This act is effective July 1, 1991.
